Jadewell cases vs. Yaranon dismissed

BAGUIO CITY (Nov. 18) — Mayor Braulio Yaranon scored twin victories in his continuing legal battle with Jadewell Parking Systems Corporation as the Office of the Deputy Ombudsman for Luzon and the Municipal Trial Court (MTC) issued decisions in favor of the mayor.

The Ombudsman, in a five-page joint order issued last September 27, upheld its earlier ruling dismissing the criminal and administrative cases filed by Jadewell Parking Systems Corporation (Jadewell) against Yaranon, city treasurer Thelma Manaois and former councilors Richard Carino and Delfin Balajadia. On the other hand, the MTC 4th branch under Judge Clarita Tabin cleared Yaranon of the slander charge filed by Jadewell personnel.

Both cases stemmed from Yaranon’s staunch campaign to stop Jadewell from apprehending violators, clamping, towing and impounding vehicles violating the ordinance on payparking. The case was about the confrontation between Yaranon and Jadewell personnel when the latter tried to tow a private car caught parked illegally along Session Road in May 2003.

Complainants Mamerto Bernos, Rodolfo Munar, Raymundo Tayaban, Jose Osiana, Januario Ulpino and Jun Cafongtan claimed that during the confrontation Yaranon shouted with contempt.

According to the ruling, Yaranon being “a public official for a long time and a former judge of both the MTC and Regional trial court would very well know the consequences of his utterances. Thus it is difficult to believe that he would blurt out words which would make him criminally liable.”

The Ombudsman denied the motion for reconsideration filed by Jadewell saying it finds no reason to reverse its earlier decision as there was no error committed in the consideration of the facts presented.# Aileen P. Refuerzo/PIO
